This document specifically outlines the terms for Intact Courier & Logistics Services for shipments originating and ending within Canada. (a) At Intact Courier & Logistics, our liability for shipments is limited to $2 per pound, with a maximum of $100, regardless of the circumstances, including issues like non-delivery, misdelivery, damage, loss, or theft. If you wish to declare a higher value for your shipment and purchase additional insurance, you must do so in writing on our order form. Otherwise, you agree to this liability limit, even in cases of gross negligence or negligence by our team, carriers, or agents. For late or delayed shipments, please refer to section 1(b) below. You can opt for Declared Value protection at an additional charge, which also covers $2 per pound up to $100 per package. This declared value protection does not apply to late or delayed shipments. The highest declared value we accept for a single shipment is $20,000, in which case our maximum liability remains $100, calculated at $2 per pound for each damaged package. We do not transport, nor can you declare a value for, articles of unusual value or personal goods. Furthermore, all jewelry shipments (excluding costume jewelry) and shipments utilizing Intact Courier & Logistics are capped at a maximum declared value of $500 per shipment. Shipments containing items like cheques, phone cards, lottery tickets, gift cards, medical/laboratory equipment, or biological samples (e.g., saliva, blood, urine) are limited to a maximum declared value of $100 per shipment and are also subject to the $2 per pound limit, capped at $100 per damaged item.
(b) Limitation of Liability for Indirect Losses: Intact Courier & Logistics is not responsible for any special, indirect, incidental, consequential, or punitive damages (referred to as “Consequential Damages”). This includes, but isn’t limited to, lost profits incurred by you or any other party due to our (or our carrier’s or agent’s) actions or omissions, such as negligence causing damage, failure to deliver, misdelivery, loss, theft, or late/delayed shipments. In such instances, our liability is limited to either a refund or credit, as specified in the current Intact Courier & Logistics Canada Terms and Conditions of Service, if your shipment qualifies for an applicable service guarantee. This limitation applies even if you’ve completed the “Declared Value of Shipment” section on the form and paid additional charges. We will not be liable for any Consequential Damages, even if we were informed of the possibility of such damages beforehand.
Claims Procedure: Claims for our on-time delivery guarantee must be submitted to Intact Courier & Logistics within 15 days of delivery. For shipments that were not delivered, claims must be made within 9 months from the date of shipment within Canada, otherwise, they will be waived. If your shipment arrives damaged, you must notify Intact Courier & Logistics as soon as possible, and no later than 30 days from the time the goods were delivered.
By using our services, the contract for carrying your goods is understood to include and be subject to these terms and conditions. These terms and conditions are binding on the shipper, consignee, and anyone else with an interest in the goods, and they are considered incorporated into any bill of lading, receipt, or other document that proves the shipping contract.
