Terms and Conditions

This document pertains to Intact Courier & Logistics Services that originate in and are destined for locations within Canada. (a) Intact Courier & Logistics’ liability is limited to $2 per pound with a maximum of $100 regardless of the circumstances. Unless a higher value is declared in writing on our order form and insurance is purchased, the shipper agrees that, for claims purposes (including those based on failure to deliver, misdelivery, damage, loss, or theft), our liability is limited to $2 per pound, with a maximum of $100, regardless of the circumstances, including but not limited to gross negligence or negligence of our employees, carriers, and/or agents. However, for late or delayed shipments, paragraph 1(b) applies. An additional charge must be paid to Intact Courier & Logistics if the shipper wishes to obtain Declared Value protection of $2 per pound, capped at $100 per package. This protection does not apply to late or delayed shipments. The maximum declared value for a shipment is $20,000, in which case, our maximum liability is $100 calculated at $2 per pound per damaged package. We do not accept for transportation and shippers may not declare a value for articles of unusual value or personal goods. In addition, all jewelry shipments (other than costume jewelry) and all shipments sent using Intact Courier & Logistics are limited to a maximum declared value of $500 per shipment. All shipments containing cheques, phone cards, lottery tickets, gift cards, medical/laboratory equipment, samples such as saliva, blood, pee, etc. or other items of a similar nature are limited to a maximum declared value of $100 per shipment and are also bound by $2 per pound per damaged item, capped at $100.

(b) Limitation of Liability for Consequential Losses: Intact Courier & Logistics shall not be liable for any special, indirect, incidental, consequential, or punitive damages (collectively, the “Consequential Damages”) including but not limited to loss of profit incurred by the shipper or any other person or company as a result of Intact Courier & Logistics (or carrier’s or agent’s) acts or omissions, including but not limited to gross negligence or negligence causing damages, failure to deliver, misdelivery, loss or theft of shipment, or late or delayed shipment. In any such event, Intact Courier & Logistics’ liability shall be limited to either a refund or credit guarantee, set forth in the effective Intact Courier & Logistics Canada Terms and Conditions of Service, if the shipment is subject to an applicable Intact Courier & Logistics Service Guarantee. This limitation of liability applies to all shipments, notwithstanding that the shipper has completed the “Declared Value of Shipment” box on the form page and is subject to paying and has paid the additional charges. In no event shall Intact Courier & Logistics be liable for any Consequential Damages even if advised in advance of the possibility of such damages.

Claims Procedure: Claims for the on-time delivery guarantee, which are not made to Intact Courier & Logistics within 15 days of delivery, or where there is a failure to make delivery, within 9 months from the date of shipment within Canada, are deemed waived. If the shipment is damaged upon arrival, the shipper must notify Intact Courier & Logistics as soon as possible, and no later than 30 days from the time the goods were delivered.

The contract for the carriage of goods listed on this record shall be deemed to include and be subject to these terms and conditions. These terms and conditions shall be binding upon the shipper, consignee, and any other person having an interest in the goods, and shall be deemed to be incorporated in and to form a part of any bill of lading, receipt, or other document evidencing the contract of carriage.
